Cancellation and Refund

Your right to cancel:

You have the right to cancel this layby sale agreement at any point prior to receiving the goods mentioned above. If you choose to cancel, you can reach out to us using the contact information provided above. You can contact us by phone, email, or mail, although please note that mail correspondence may take longer to reach us. It is important that you clearly express your intention to cancel the agreement. Once we receive your cancellation request, we will refund any payments you have made, after deducting any applicable cancellation fees. Please refer to the Sales Terms below for specific situations where we may also cancel the agreement.

 

Cancellation fee:

We reserve the right to impose a cancellation fee in the event that you decide to cancel this agreement or if we cancel the agreement due to your violation of a significant term, such as failing to make full payment by the agreed-upon date.

The cancellation fee we charge will be determined by assessing the decrease in value of the goods from the date of this agreement to the cancellation date, along with reasonable administration costs. We will subtract this amount from any payments you have made and then refund you the remaining balance. If the amount you have paid is insufficient to cover the cancellation fee, we have the right to collect the outstanding amount from you.

Please note that no cancellation fees will be applied if the contract is cancelled within 5 working days of receiving a copy of this agreement.

 

Delivery:

  1. We will make arrangements to deliver the goods to your residential address within 10 working days once the required number of payments has been made. In the event of any late payment to us, whether it is for the delivery or subsequent payments, we reserve the right to postpone delivery until all outstanding payments have been settled. Please note that any estimated delivery time provided is approximate, and we shall not be held responsible for any delivery delays beyond our control. Time is not of the essence in this matter.
  2. The postage and handling charges will vary between $30 and $300, depending on the size and weight of the product. The specific postage and handling fee will be clearly stated on the sales terms form. The amount you are charged for postage will be equal to or less than the actual amount paid to a third-party service provider by us.
  3. If a delivery is returned to us due to outdated contact information in our database or your unavailability, we will retain the purchased products until we can establish contact with you to confirm your current delivery address. In case of an extended delay, we may, at our discretion, apply a storage fee.
  4. It is your responsibility to ensure that someone is available to receive the products during the designated delivery period.
  5. Once the products have been delivered to the address specified on the sales terms form, we will not be liable for any missing or damaged items.

 

Product Guarantee:

  1. We are committed to fulfilling all our obligations under the Consumer Guarantees Act, the Fair Trading Act, and any other applicable legislation that safeguards your rights as our valued customer.
  2. Any other warranties or representations, whether explicitly stated or implied, regarding the product(s), are excluded to the fullest extent permitted by law.
